Exide® Batteries/Nascar® Angels Sweepstakes

  1. Eligibility: NO PURCHASE NECESSARY. The Exide Batteries/NASCAR Angels Sweepstakes (“Sweepstakes”) is open to legal U.S. residents, 18 years or older. Employees of Exide Technologies (“Exide”), NASCAR, Inc., MagicDust Television, LLC, participating retailers, their affiliates, subsidiaries, advertising and promotion agencies and the immediate families (spouse and parents, siblings and children and each of their spouses) and persons living in the same households of each of the above are ineligible. VOID WHERE PROHIBITED BY LAW. Exide Technologies, 13000 Deerfield Pkwy Bldg 200, Alpharetta, GA 30004 is the sponsor of this promotion. NASCAR, Inc., MagicDust Television, LLC, Sunoco, Inc. (R&M) and the prize manufacturers are not sponsors of this promotion. NASCAR, Inc. and Sunoco, Inc. have no liabilities or obligations in connection with this promotion.
  2. How to Enter: The Sweepstakes begins on or about July 26, 2008 and ends on August 24, 2008 (the “Promotion Period”). By entering this Sweepstakes, entrants agree to be bound by these Official Rules, the rules and conditions found on the Entry Form and the decisions of Exide, which are final and binding in all respects. Limit one (1) entry per person. If multiple entries are received from the same person, only the first entry may be considered and all subsequent entries may be disqualified. To enter, complete the online Exide Batteries/NASCAR Angels Sweepstakes Official Entry Form found at www.exidechargeupyoursummer.com or include your name, address, city, state, zip code, telephone number, email address and make/model/year of vehicle on a 3x5 card and mail to: Exide Sweepstakes, 4747 E. Elliot Rd. #29-511, Phoenix, AZ 85044. Entries must be postmarked by August 25, 2008 and received by August 29, 2008. No mechanically reproduced, illegible, incomplete or forged entries will be accepted. Exide is not responsible for lost, late, illegible, misdirected, damaged, incomplete, or postage-due entries.
  3. Drawing: On or about September 5, 2008, a random drawing will be conducted from all online and mail-in entries by Mighty Interactive (marketing agency). The odds of winning depend on the number of entries received.
  4. Prizes: There is one (1) Grand Prize consisting of a Portable GPS automotive navigation system, Exide NASCAR Extreme or Select battery, iPod® 80 GB, 8.5” Portable DVD player with bonus pack, SIRIUS® satellite radio Sportser 5 with one year subscription and one year of free Sunoco® gas or cash equivalent not to exceed $2600, with an estimated value of approximately $3800 for this complete package. Prize is non-transferable. There are also thirty (30) Instant $10 Sunoco gas cards or cash equivalent, to be awarded to one (1) winner per day during the Sweepstakes, through a random drawing conducted from all online and mail-in entries by Mighty Interactive. The total estimated value of these cards is approximately $300. All taxes on prizes awarded are responsibility of the winner.
  5. Notification of Winners/Claiming Prizes: The Grand Prize winner will be notified by mail and will be required to sign and return an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, within 14 days of the first notification attempt. If the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner will be selected through the same random drawing procedure. Instant Prize winners will receive their prize by mail. Exide shall have no liability for any winner notification or prize that is lost, intercepted or not received by the potential winner for any reason. If any potential winner is found to have not complied with these Official Rules, such person will be disqualified and an alternate winner will be selected.
  6. Additional Terms: Exide reserves the right in its sole discretion to disqualify any individual who is found to be acting in violation of these Official Rules, or to be acting with the intent to disrupt or undermine the legitimate operation of the Sweepstakes. In the event that any provision of these Official Rules or of the rules and conditions of the Entry Form is determined to be invalid or otherwise unenforceable or illegal, the rules shall otherwise remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were modified so as to be in compliance with the applicable state, local or other legal requirement. Official Rules located at www.exidechargeupyoursummer.com ALL ISSUES CONCERNING THESE RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES. EACH SWEEPSTAKES ENTRANT AGREES THAT THE COURTS LOCATED IN ATLANTA, GEORGIA SHALL HAVE EXCLUSIVE JURISDICTION OVER ANY PROCEEDING ARISING OUT OF OR BASED UPON THE SWEEPSTAKES OR THESE RULES, AND EACH ENTRANT HEREBY WAIVES ANY CLAIM THAT HE/SHE IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE. Exide shall not be liable for any suspension or termination of the Sweepstakes due to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or any cause not reasonably within Exide’s control, and in the event the Sweepstakes is terminated as a result of any such event, the Prize winners will not be entitled to substitute prize(s) or monetary entitlement, except as provided by applicable law.
  7. Winners’ List: Winners list will be posted on www.exidechargeupyoursummer.com or may be obtained by sending a self-addressed stamped envelope to Exide Sweepstakes, 4747 E. Elliot Rd. #29-511, Phoenix, AZ 85044. All such requests must be received by September 15, 2008, unless longer period is required by applicable law. Vermont residents may omit return postage.
